La instauración del sistema penal acusatorio en varios países de Latinoamérica ha enfrentado el reto, entre muchos, de configurar nuevos estándares para la actuación judicial. Este artículo se centra en el reto que representa para los juzgadores valorar la confiabilidad de la prueba científica, dado que su naturaleza excede el conocimiento de la mayoría de ellos. Evaluar la confiabilidad y corrección de la prueba científica para asignarle un peso específico en el acervo probatorio es una labor para la que el (...) juez requiere de un análisis multidisciplinario. A manera de guía para el juzgador y como una herramienta innovadora en el ambiente judicial latinoamericano, se proponen lineamientos generales y específicos a seguir en la valoración de la confiabilidad de la prueba en tres áreas forenses. Nowadays, the quality standards of higher education institutions pay special attention to the performance and evaluation of the students. Then, having a complete academic record of each student, such as number of attempts, average grade and so on, plays a key role. In this context, the existence of missing data, which can happen for different reasons, leads to affect adversely interesting future analysis. Therefore, the use of imputation techniques is presented as a helpful tool to estimate the value of missing (...) data. This work deals with the academic records of engineering students, in which imputation techniques are applied. More specifically, it is assessed and compared to the performance of the multivariate imputation by chained equations methodology, the adaptive assignation algorithm based on multivariate adaptive regression splines and a hybridization based on self-organisation maps with Mahalanobis distances and AAA algorithm. The results show that proposed methods obtain successfully results regardless the number of missing values, in general terms. (shrink)

Las estadísticas muestran que la tasa neta de escolarización en los estudios de grado en España aumenta significativamente. En esta investigación se pretende explorar la evolución de la cuenta de resultados y balance de aquellas empresas españolas de educación universitaria privada. Empleando los datos publicados en la base de datos SABI se han analizado las empresas con mayor volumen de facturación y total de activos. Como hallazgos principales se ha observado un incremento de la cifra de negocios y del resultado, (...) del orden del 40% y 20% respectivamente. No así la inversión en activos que se ha mantenido. _María Zambrano. __A Life of Poetic Reason and Political Commitment _de Beatriz Caballero Rodríguez y _The Cultural Legacy of María Zambrano_, editado por Xon de Ros y Daniela Omlor, son dos recientes aportaciones críticas al pensamiento de María Zambrano, pioneras en su contexto al constituir los dos primeros libros monográficos en lengua inglesa sobre esta filósofa y escritora. Por ello se abordarán en una reseña conjunta con el fin de mostrar la vigencia del pensamiento de Zambrano en el siglo XXI.

Es necesario establecer entornos sociales para la protección de la prensa en contextos de violencia centrada en los periodistas. En estos entornos interactúan tres esferas: la política institucional, la de justicia y la civil. México es una de las naciones con más agresiones a periodistas, lo que obliga a considerar las formas de ofrecer protección a la prensa.

The aim of this study is twofold: one, to determine the presence and function of scientific knowledge when it is required by such cases as `mad cow' disease, when the crisis breaks in the press; and two, to explore the role of scientific information through the analysis of quoted speech used by journalists in their discourse. Citation is the most explicit form of inclusion of other-discourse in one's-discourse. Within the framework of the theory of énonciation, in combination with a critical (...) view of discourse, we analyse the following: the identity of agents of reference chosen by journalists; the specific linguistic choices made in the pre-citation segment where the agents are introduced, that is, identification of discourse procedures and use of specific verbs of communication. The study shows the proportion of scientific and non-scientific voices, the different ways of representing science agents in the process of news communication as well as the use of citation by journal writers not just to confer authority and legitimation to their discourse but to set the scene of the conflict. The scientific role is not presented as a decisive social role capable on its own of reassuring public alarm and journalists fail to secure appropriate credibility for the scientific community. As a discourse genre, statements of purpose are characterized by their occluded status in the academy and by their hybrid nature. Statements of purpose are required in applications for a place in a postgraduate course, and they are requested to obtain information about the academic and professional background and skills of each applicant. A study of the genre’s linguistic and textual features is needed in Spanish to discover and understand writers’ and readers’ perception of this genre. A corpus of 50 (...) motivation letters in Spanish is analyzed here. We study the distinguishing macro- and microtextual features of this particular genre and co-occurrences between both kinds of features. At the macrotextual level, statements of purpose display prototypical rhetorical moves, which can be classified as writers’ moves and readers’ moves. On the microtextual level, modalization resources and discourse markers are discussed. This multiple perspectives analysis of the corpus shows evidence of significant co-occurrences among modalization, discourse markers, and rhetorical moves. Writers’ ideal representations of this discourse genre, which spans the academic and professional fields, can also be deduced. (shrink)

Business Ethics: A European Review, EarlyView.

The article analyzes three different cases of clinical research in which children are asked to participate. Participation of children in researches is one of the major challenges for Bioethics and societies nowadays due to the tensions and issues concerning the guarantee of rights in clinical research, the responsibilities of the different actors involved, and the purpose of improving the quality of life without affecting scientific freedom and new knowledge production. The aim of the article is to establish the way in (...) which autonomy is exercised, considering ethical and regulative aspects within clinical research involving children. In order to achieve such a purpose, case study research methodology is employed, revealing the tensions and ethical issues involved in this particular kind of clinical research as well as considering international documents and the national regulation regarding this particular problem. This research aims to describe how practicing lawyers perceive ‘plain writing’ in the legal field and to conceptualize this notion through the discourse analysis of these specialists. To do so, a qualitative research framed in the interpretive paradigm has been developed. Specifically, 18 practicing lawyers, from different countries and with different specializations in the practicing of Law, were surveyed. After analyzing the discourse of the interviewed lawyers, eight macro categories accounting for plain language both generally and particularly were identified. The (...) audience was identified as a key element in the production of legal texts which facilitate justice to citizens. Based on our analysis, we conclude with a definition of plain writing. Autonomy is conceptualized as the need for agency, self-actualization and independence. Nowadays, financial independence and academic achievement for young populations may be considered as key aspects in the transition to adulthood in response to some contextual demands of different cultural environments. By means of a multi-level model, the present study aims to determine the influence and contribution of factors at individual-level (e.g. sex, age, socioeconomic status, family financial support, awarded scholarships, personal finance, student loans) and school-level (e.g. programme quality, online (...) programs, face to face programs) on the academic achievement of young higher education Colombian students. Data come from the scores of the national standardized academic achievement test administered in 2018 in Colombia. The sample included 234,386 students enrolled in 3,389 higher education institutions in Colombia. After controlling the effects of program quality, and the student's previous academic abilities and socio-economic conditions, results showed that students with scholarships had higher scores than financially-dependent students (those who had students loans) and financially-independent students (those who self-funded their studies or who worked during the week) who had low-scores in the national standardized academic achievement test. Reading, even when silent and individual, is a social phenomenon and has often been studied as such. Complementary to this view, research has begun to explore how reading is embodied beyond simply being ‘wired’ in the brain. This article brings the social and embodied perspectives together in a very literal sense. Reporting a qualitative study of reading practices across student focus groups from six European countries, it identifies an underexplored factor in reading behaviour and experience. This factor is the sheer (...) physical presence, and concurrent activity, of other people in the environment where one engages in individual silent reading. The primary goal of the study was to explore the role and possible associations of a number of variables (text type, purpose, device) in selecting generic (e.g. indoors vs outdoors) as well as specific (e.g. home vs library) reading environments. Across all six samples included in the study, participants spontaneously attested to varied, and partly surprising, forms of sensitivity to company and social space in their daily efforts to align body with mind for reading. Fundamental motor skills of children can be affected by different variables, such as executive functions, gender and relative age. However, the effects of these variables on FMS have been scarce studied, especially in early childhood, and show inconsistent results. To clarify these relationships, this study was carried out. Its aim was to analyze whether EF, gender and relative age influenced FMS in 43 Spanish kindergarteners. A multimethod and mixed methods approach was used. Kindergarteners’ teachers completed the Childhood Executive Functioning Inventory (...) to know the children level of EF. Kindergarteners’ parents complimented ad hoc questionnaire reporting the children gender and birth data. A Nomothetic/Punctual/Multidimensional observational design was used to observe children FMS in their habitual motor sessions at school. Two-way ANOVAs were performed to know the independent and interactive effects of working memory level, inhibition control level, gender and relative age on FMS. Results showed these variables have independent and interactive effects on some FMS, but not on others. FMS influenced by these variables vary depending what independent variable is/are considered. Therefore, it can be concluded that the influences of teacher-rated EF, gender and relative age on observed FMS in kindergarteners are complex and specific. Results obtained must be taken into to design and implement instructional and intervention strategies, as well as educational and sport policy changes, especially in early childhood, when FMS are more malleable. The versatile clustered regularly interspaced short palindromic repeats (CRISPR)/Cas system has emerged as a promising technology for therapy and molecular diagnosis. It is especially suited for overcoming viral infections outbreaks, since their effective control relies on an efficient treatment, but also on a fast diagnosis to prevent disease dissemination. The CRISPR toolbox offers DNA‐ and RNA‐targeting nucleases that constitute dual weapons against viruses. They allow both the manipulation of viral and host genomes for therapeutic purposes and the detection of viral (...) nucleic acids in “Point of Care” sensor devices. Here, we thoroughly review recent advances in the use of the CRISPR/Cas system for the treatment and diagnosis of viral deleterious infections such as HIV or SARS‐CoV‐2, examining their strengths and limitations. We describe the main points to consider when designing CRISPR antiviral strategies and the scientific efforts to develop more sensitive CRISPR‐based viral detectors. Corporate social responsibility has an impact on many areas of society, and it has recently been active in the digital space, a growing area of business activity. However, certain factors prevent it from firmly establishing itself in this area. One of these factors is the lack of user trust. Certain instruments have been created to address this issue, such as codes of conduct that seek to mitigate the causes of distrust by making significant improvements in the regulations and ethical standards (...) applicable to business transactions. These instruments are the product of industry self-regulation and complement rather than substitute for effective legal regulations. Positive Psychology has turned its attention to the study of emotions in a scientific and rigorous way. Particularly, to how emotions influence people’s health, performance, or their overall life satisfaction. Within this trend, Flow theory has established a theoretical framework that helps to promote the Flow experience. Flow state, or optimal experience, is a mental state of high concentration and enjoyment that, due to its characteristics, has been considered desirable for the development of the performing activity of performing musicians. Musicians (...) are a population prone to health problems, both psychological and physical, owing to different stressors of their training and professional activity. One of the most common problems is Musical Performance Anxiety. In this investigation, an electronic intervention program was carried out for the development of psychological self-regulation skills whose main objective was to trigger the Flow response in performing musicians and the coping mechanism for Musical Performance Anxiety. A quasi-experimental design was used with a control group in which pre- and post-measures of Flow State, Musical Performance Anxiety and, also, Social Skills were taken. Sixty-two performing musicians from different music colleges in Spain participated in the program. Results indicated that the intervention significantly improved Flow State, and Sense of Control, and decreased Music Performance Anxiety, and self-consciousness of the participants in the EG but not CG. The changes in the EG after the program showed the inverse relationship between Flow and Anxiety. Two important theoretical factors of both variables, such as worry and the feeling of lack of control, could be involved. The results are under discussion and future lines of research are proposed. Advertising is a booming activity both in the physical realm and on the Internet. Online advertising is growing and is subject to legal standards, although some self-imposed ethical standards for the industry are needed. This has been called self-regulation. This article examines the important role that self-regulation can play in addressing advertising that uses degrading and discriminatory images of women that compromise their dignity. Sexist advertising is a reification of women—stereotypes and sexist social models—that do not convey a realistic image (...) of a woman’s abilities and potential. This article analyzes specific decisions on the subject issued by the Jury of the Spanish Association for the Self-Regulation of Commercial Communication. The Jury’s decisions are based on a code of ethics. The technical expertise and impartiality manifested in its decisions have produced a high degree of credibility and confidence in the organization. ObjectiveThis study aimed to analyse how stereotypes towards older people moderate the relationship between burnout and quality of life of professionals working in nursing homes.MethodA total of 312 professionals were asked to complete questionnaires of burnout Maslach Burnout Inventory quality of Life and aging stereotypes. The moderation effects were tested using linear regression models.ResultsA negative association was observed between burnout and QoL. It was also found a statistically significant moderator effect of the total score of stereotypes and the health stereotypes, (...) besides a marginally statistically significant moderator effect for motivational stereotypes. The moderator effects were different for people with low and high negative stereotypes. QoL was more affected under conditions of high burnout, in which people with more negative stereotypes tended to present higher QoL than people with lower negative stereotypes.ConclusionHighly burned-out professionals in nursing homes may avoid their negative feelings projecting them to residents through stereotypes, as a way of coping with burnout and increasing their QoL. However, this mechanism is an “aggressive reaction” and may have negative effects for both the older adult and the professional. The comprehension of these variables is essential for developing adequate intervention programs. (shrink)

This research aims to fill a major gap in the relevant literature on small businesses in developing countries, specifically concerning the development of models to better explain economic and environmental performance as a result of environmental compliance, thus moving toward an explanation of the sustainable behavior of these businesses. Data from 186 pottery craft businesses located in three Mexican states (Oaxaca, Puebla and Tlaxcala) reveal that environmental compliance significantly influences economic and environmental performance, with the mediating role of environmental innovation, (...) confirming the Porter hypothesis in the context of small businesses in an emerging economy. Este artículo pretende dilucidar el significado del sentir profundizando en la fenomenología genética y dialogando con la ontología fenomenológica, particularmente con la Métaphysique du sentiment de R. Barbaras. Comienza descubriendo los sentidos del cuerpo y lo que denominamos “re-flexión” corporal, siempre vinculada a la aisthesis (lato y stricto sensu) y a la afectividad. Aborda posteriormente la correlación entre fenomenología y estética como ejemplo de la pasividad en la actividad del sentir. Comprenderemos esta dinámica como movimiento ontológico que aúna la aisthesis (...) con el logos y exige ser expresado. Cézanne estará presente en esta investigación, como lo estuvo en la obra de Merleau-Ponty y de Maldiney, porque su pintura encarna ese movimiento en el que la creación es necesaria para experimentar y expresar el ser, y porque filosofía y arte son indispensables para sentir y pensar. Aceptaremos la crítica que Barbaras dirige Maldiney, mientras que continuaremos desarrollando la ontología fenomenológica de Merleau-Ponty para arrojar luz sobre le sentir. (shrink)

Se presenta una propuesta de innovación educativa, dirigida al alumnado de Educación Secundaria, fundamentada en el uso de los itinerarios didácticos teatralizados como recurso didáctico con perspectiva de género. Para su confección se pretende una metodología que privilegia los contenidos procedimentales y que fomenta el pensamiento histórico y, por ende, el pensamiento crítico. Los contenidos seleccionados están relacionados con el siglo XVI y XVII y, más concretamente, con la persecución y procesamiento de mujeres por brujería y hechicería por parte del (...) Tribunal de la Inquisición. Para ello se toma como centro de estudio el proceso que se llevó a cabo en Córdoba contra Leonor Rodríguez, lo que llevará al alumnado a reflexionar y a preguntarse sobre los estereotipos de la mujer en la historia, así como en la actualidad, con la intención de formar a una ciudadanía crítica y comprometida. The “phenomenology of existence” is one of the contemporary currents of philosophy which have developed taking existence as its central concern. The purpose of this article is to present my conception of this fundamental field of phenomenological research. In order to do this, I will analyze phenomenology of existence in the double sense of the genitive or better as a bidirectional phenomenological- existential movement; that is to say, on the one hand, I will explore the sense and scope of phenomenology (...) for existence and, on the other hand, the meaning of existence for the phenomenological existential movement. With the aim of describing this twofold dynamics, I will begin by clarifying certain concepts of the Husserlian method that have frequently either been ignored or misinterpreted and, therefore, have impeded us from understanding the meaning of what the founder of phenomenology called “personal existence.” After this elucidation that takes place at the static level of phenomenology, I will apply some key concepts of genetic phenomenology to existence in order to develop my own account of the existential phenomenology. Given that Maurice Merleau-Ponty (1908–1961) was a pioneer in the study of the most representative Husserlian texts dealing with the major issues of genetic phenomenology–such as time, space, lived body, intersubjectivity and lifeworld—, I will draw from his philosophy to open a dialogue with María Zambrano (1904–1991), as an example of the possibilities offered by a—comparative—phenomenology for the study of existential problems, specifically for the development of a phenomenology of sensing and being sensed that goes beyond of the paradigm of representation. Se ha realizado una revisión sistemática siguiendo el protocolo PRISMA para caracterizar la producción científica de la didáctica de la higiene alimentaria en Educación Primaria. Se analizan indicadores bibliométricos y metodologías de investigación utilizadas. La búsqueda se realizó en la base de datos Web of Science. Solo 12 artículos cumplían con todos los criterios de inclusión. Hay escasas publicaciones sobre higiene alimentaria en la etapa, tratándose de estudios cualitativos, autoría conjunta y en su mayoría pertenecen al sector sanitario. Es necesario (...) aumentar las investigaciones especialmente en el ámbito educativo e introducir la higiene alimentaria en la formación del profesorado. (shrink)

Su rechazo del sistema va unido a su comienzo en la intuición y a su decurso temporal, que analizamos en relación con Bergson y Husserl. La razón poética va más allá de ese núcleo intuitivo para revelar re-flexivamente incluso lo invisible. Su inmersión en las profundidades, en la pasividad actuante, en las entrañas, en la multiplicidad de los tiempos es paralela a la fenomenología de la génesis merleau-pontiana, (...) a su poiesis carnal e incluso al telos de una razón ampliada al sentir.
